Facts:

On September 16, 1988, the Laban ng Demokratikong Pilipino (LDP) was reorganized, results to realignment in the House of Representatives. 24 members of the Liberal Party (LP) resigned and joined the LDP, members rose to 159 and reducing their former party to only 17 members. Due to the movement, Petitioner an LP was removed from the Commission on Appointment (CA). On January 13, 1989, he challenged his removal from the CA and the assumption of his seat by the respondent. Petitioner contend that he cannot be removed because his election is permanent under Cunanan v. Tan. Respondents argued that the issue is political in nature and this court has no jurisdiction.

(Petition was dismissed because a constitutional stalemate had to be resolved)

No. under the constitution "there shall be a Commission on Appointments consisting of twelve (12) Senators and twelve (12) members of the House of Representatives elected by each House, respectively, on the basis of proportional REPRESENTATION OF THE POLITICAL PARTIES THEREIN," connotes the authority of each House of Congress to see to it that this requirement is duly complied with. It is understood that such changes must be permanent and do not include the temporary alliances or factional divisions not involving severance of political loyalties or formal disaffiliation and permanent shifts of allegiance from one political party to another.
